Terms of Service

1. Acceptance of Terms

By accessing or using Leads by Alex ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Leads by Alex provides a subscription-based platform that monitors publicly available court records and aggregates lead information, including probate, eviction, foreclosure, and divorce filings, and delivers that information to subscribers. The Service is intended for use by real estate professionals, investors, and related businesses.

3. Subscriptions and Billing

Access to the Service requires a paid subscription. Subscription fees are billed on a monthly basis. All plans cover one (1) state. Additional states may be added for $79 per month each, per state. Prices are listed in US dollars and are subject to change with notice.

By subscribing, you authorize Leads by Alex to charge your payment method on a recurring monthly basis until you cancel. You are responsible for all charges incurred under your account.

Plan-level features

Features available to you depend on your active subscription tier:

• Free: 25 sample leads, dashboard access, manual filters, CSV export, pay-as-you-go skiptrace at $0.20/lead.
• Starter ($79/mo): All lead types, 30-day history, weekly delivery every Monday by 6 AM CST, CSV export, skiptrace at $0.15/lead.
• Pro ($149/mo): All Starter features plus daily delivery by 6 AM CST, 90-day history, owner type and zip code filters, and skiptrace at $0.12/lead.
• Elite ($297/mo): All Pro features plus instant lead delivery, unlimited history, saved filters, auto-skiptrace on filters, webhook and Zapier integration, and skiptrace at $0.10/lead.

Saved filters, auto-skiptrace automation, and webhook integrations are available on the Elite plan only. Starter and Pro subscribers may filter leads manually from the dashboard but cannot save filter configurations or attach webhook endpoints.

4. Money-Back Guarantee and Cancellations

We offer a 7-day money-back guarantee on all new subscriptions. If you are not satisfied within the first 7 days of your initial subscription, contact us at alex@leadsbyalex.com and we will issue a full refund. After the 7-day period, subscription fees are non-refundable.

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of your paid period.

Wallet balances and skiptrace credits

Wallet top-ups and skiptrace credit purchases are non-refundable once processed. Credits do not expire and carry over indefinitely, including after subscription cancellation or plan downgrade. If you believe a charge was made in error, contact us at alex@leadsbyalex.com within 30 days and we will investigate.

Skiptraced lead retention

Any lead you have personally skiptraced is retained in your dashboard permanently, regardless of your current subscription tier, plan history window, or account status. Skiptraced leads will never be hidden or removed as a result of a downgrade or cancellation.

5. Promo Codes

Promotional codes may be applied at registration and provide discounts as described at the time of use. Promo codes are non-transferable, may not be combined with other offers, and may have usage limits or expiration dates. Leads by Alex reserves the right to modify or discontinue promotional offers at any time.

6. Use of Data

The lead data provided through the Service is sourced from publicly available court records. You agree to use this data only for lawful purposes and in compliance with all applicable federal, state, and local laws, including but not limited to the Fair Debt Collection Practices Act, CAN-SPAM Act, and Telephone Consumer Protection Act. You are solely responsible for how you use the lead data.

You may not resell, redistribute, sublicense, or otherwise commercialize the lead data to third parties without prior written consent from Leads by Alex.

7. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at alex@leadsbyalex.com if you suspect any unauthorized use of your account.

8. Intellectual Property

The Service, including its software, design, text, and graphics, is the intellectual property of Leads by Alex. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your own business purposes. You may not copy, modify, distribute, sell, or lease any part of the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the data will be complete, accurate, or up to date. Court records may contain errors, omissions, or delays that are outside our control.

10. Limitation of Liability

To the maximum extent permitted by law, Leads by Alex and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or use the Service in a way that harms other users or third parties. Upon termination, your right to access the Service will immediately cease.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Wisconsin.

14. Company Information

Leads by Alex is a service operated by Cash Offers by Alex LLC, a Wisconsin limited liability company. References to "Leads by Alex," "we," "us," or "our" in these Terms refer to Cash Offers by Alex LLC and its Leads by Alex service.
